Notice of Alleged Infringement

Processing of the Infringement Notice

Upon receiving a properly formatted notice of alleged copyright infringement, our designated Copyright Agent will undertake the following steps:

  1. Review of the Infringement Notice: We will review the infringement notice to determine its completeness and validity. A notice must contain all required elements as outlined in our Notice of Alleged Infringement section to be considered valid.
  2. Investigation: Upon receiving a valid notice, we will conduct a preliminary investigation into the claim. This investigation will aim to verify the facts stated in the notice and to determine the legitimacy of the copyright claim. This may include reviewing our records to ascertain whether we have a valid license or authorization for the use of the allegedly infringing material.
  3. Response to the Claim: Our response to the claim will depend on the outcome of our investigation:
    • If Infringing: If our investigation concludes that the material is indeed infringing and we do not have a valid license or authorization, we will act expeditiously to remove or disable access to the material claimed to be infringing.
    • If Not Infringing: If we determine that we have a valid license or authorization for the use of the material, or if the claim is otherwise found to be without merit, we will not remove the material. In such cases, we will inform the claimant of our findings and provide an explanation of why the material will not be removed.
  4. Notification to the User: If the material is removed or access to it is disabled, we will make reasonable efforts to notify the user who posted the material, informing them of the action taken and the reasons for it.
  5. Documentation and Record-Keeping: We will keep detailed records of the infringement notice, our investigation, and any actions taken in response to the claim. This documentation will be retained in accordance with our legal obligations and company policies.
